PIPEDA & Hiring a Private Investigator..
Not all private investigators have been granted Investigative Body Status under PIPEDA and it is important that your organization protect itself by ensuring your investigators are.
Effective March 31, 2004, Private investigators were designated in the Regulations of the Personal Information Protection Electronic Documents Act (PIPEDA) as Investigative Bodies for the purposes of Section 7 (3)(d) and 7(3)(h.2) of the Act the provisions pertaining to non-consensual disclosure of an individuals personal information to and from third party organizations.
The Investigative Body Designation does not Exempt Organizations From PIPEDA?
The Investigative Body status does not exempt private investigators from PIPEDA. In general, consent must be obtained from an individual if personal information is going to be collected, used, or disclosed as part of a commercial transaction between organizations.
The Investigative Body regulation is crucial to private investigation agencies for two reasons. PIPEDA states that an organization may only disclose the personal information of an individual without the persons consent, to an investigative body. The Acts definition of an organization includes any person.
Without Investigative Body status, it would potentially be unlawful for any person or organization to disclose an individuals personal information to a private investigator.
The Act further states that in order to disclose personal information that has been collected without an individuals consent must be to an investigative body. Now, with this regulation in place, persons may legally give personal information to private investigators and they may share this information with other investigative bodies.
Not all Private Investigators are Investigative Bodies?
For private investigators, Industry Canada has reported that all private investigation companies be incorporated or operated as a partnership in order to fulfill the definition of Body. Industry Canada further requires that all private investigation companies be licensed by province, be members in good standing with a professional association that has a privacy code compliant with the CSA model code, and have a corporate privacy code comparable to this standard as well.
The simple steps to making sure your investigators have the status are:
¨ Get a copy of the investigations firms Articles of Incorporation or Partnership Agreement;
¨ Obtain a copy of their PI license to operate as a PI agency;
¨ Obtain a copy of their privacy code and compare it to the CSA Model Code; and
¨ Confirm they are a member in good standing of a Professional organization that represents the interest of PI
